Definitions
AdPerformo (referred to as either «We», «Us» or «Our» in this Agreement) refers to LINGO VENTURES LTD .
User/Client refers to the individual or entity utilizing Adperformo's services, either as a private individual or as a legal entity.
Website refers to http://adperformo.com.
Services include digital creative marketplace platform, which connects freelancers and customers, who desire to order a wide range of creative marketing products or solutions.
Contractor refers to the independent professional performing the creative marketing services.
Meaning the individual accessing or using the Service, the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
01. Nature of Services
Adperformo is a creative marketing marketplace that acts as an intermediary between clients (both individuals and legal entities) and freelance professionals providing digital creative services. Clients submit project requests through the Adperformo platform, and Adperformo independently assigns each request to a suitable freelancer based on their expertise, portfolio, and results of our internal assessments.
Adperformo takes an active role in the project workflow. We review the client’s brief, select and assign the freelancer, monitor the quality and timing of the work, coordinate communication if needed, and manage the final delivery. Adperformo also handles all payment processing, with freelancers receiving payment after the client accepts the completed work. In the case of large or complex projects, partial delivery and milestone-based payments may be arranged.
The services available through the platform include a wide range of digital creative products such as stock image collections, typography and licensed fonts, basic and custom logo designs, icon packs, infographic design at various levels of complexity, animated visuals for social media advertising, banner design for websites, thumbnails for podcasts and video content, animated intro templates, social media branding kits, complete website UI/UX design, 3D product mockups, AI-generated voiceovers for video content, custom illustrations for digital campaigns, and full-scale brand identity systems.
Adperformo specializes in non-certified, non-notarized creative deliverables. Unless explicitly agreed otherwise in writing, the content delivered through our platform is not intended for legal or official use. Clients are permitted to use completed work for commercial, editorial, marketing, educational, or internal purposes, including public distribution through websites and social media platforms.
All freelancers working with Adperformo undergo a structured onboarding process that includes a test project, ongoing quality monitoring, and internal performance reviews. Freelancer compensation is based on the quality and consistency of their work, incentivizing continuous improvement and helping us maintain reliable standards across all projects.
02. Overview
Throughout this website, the terms “we,” “us,” and “our” refer to Adperformo. Adperformo operates this website and provides access to a range of information, tools, and creative services made available through the platform, subject to your acceptance of all terms, conditions, policies, and notices stated herein.
By accessing our website, registering an account, submitting a project brief, or engaging in any transaction on the platform, you are using our “Service” and agree to be bound by these Terms of Use (“Terms”), including any additional terms, conditions, and policies referenced herein or made available via hyperlink. These Terms apply to all users of the website, including but not limited to browsers, clients, freelancers, and content contributors.
Please read these Terms carefully before accessing or using any part of the website or services. By using any functionality of the site, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to all of the terms and conditions in this agreement, you may not access the platform or use any services provided through it. If these Terms are considered an offer, acceptance is expressly limited to the scope of these Terms.

Your continued use of the platform, including browsing, submitting project briefs, accepting freelance assignments, or otherwise engaging with any aspect of the service, will be considered as your acceptance of the updated Terms. 04. Registration and Activation
In order to access and use the services offered by Adperformo, all users are required to create an account on the platform. During the registration process, you must provide accurate, current, and complete information, including your full legal name as it appears on official identification documents.
By registering, you confirm that the information you provide is truthful, that it accurately represents your identity or the legal entity you are authorized to represent, and that you have not used another person’s or entity’s information without proper authorization. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Adperformo reserves the right to suspend or terminate any account that provides false, misleading, or incomplete information, or that violates any part of these Terms of Use.
05. Fraud Prevention
Adperformo takes fraud prevention seriously. If it is determined that your account was created using false, misleading, or fraudulent information, or if services were paid for using a payment method that does not belong to you and was used without proper authorization, your account may be suspended or permanently terminated without prior notice. We reserve the right to take any further legal action necessary to protect the integrity of the platform and its users.
06. Email Verification
Upon registration, a verification link will be sent to the email address you provided. Your account will only be activated after successful confirmation of this email. Email verification is a mandatory step, and no completed orders will be delivered or made accessible until this confirmation has been completed.
07. Online Store Terms
By accepting these Terms of Use, you confirm that you are of legal age in your country, state, or province of residence, and that you have the legal capacity to enter into binding agreements. If you are granting access to the platform to any minor dependents, you affirm that you have the legal right and authority to do so, and you assume full responsibility for their use of the platform.
You agree not to use any services or content offered through Adperformo for any unlawful or unauthorized purposes. You must comply with all applicable laws and regulations in your jurisdiction, including but not limited to those related to intellectual property and copyright.
You are strictly prohibited from transmitting any malicious code, viruses, worms, or other harmful components through the platform. Any breach or violation of these Terms, including engaging in illegal activities or compromising platform security, may result in the immediate suspension or termination of your account, without prior notice.
08. Prohibited Uses
Adperformo strictly prohibits the use of its platform, services, or delivered content for any unlawful, unethical, or fraudulent purposes. This includes, but is not limited to, the submission or use of fabricated materials such as falsified contracts, fake identification documents, or work intended to support academic dishonesty. It also includes any content that promotes hate speech, violence, discrimination, or otherwise violates community standards and professional ethics.
In addition to the restrictions outlined throughout these Terms of Use, you agree not to use the website or its content for any of the following:
- for any unlawful or unauthorized purpose;
- to solicit others to participate in any unlawful activity;
- to violate any applicable local, national, or international law, regulation, or ordinance;
- to infringe upon or violate the intellectual property rights of Adperformo or any third party;
- to harass, abuse, defame, slander, intimidate, or discriminate against others on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
- to submit false, misleading, or deceptive information;
- to upload or distribute malicious code, viruses, or any technology intended to harm the platform, users, or the Internet;
- to collect or attempt to collect personal information about other users without consent;
- to engage in any spamming, phishing, pretexting, crawling, scraping, or similar unauthorized data gathering methods;
- to use the platform or its content for obscene, immoral, or exploitative purposes; or
- to interfere with, bypass, or otherwise compromise the security features of the platform or any associated systems.
Adperformo reserves the right to monitor user activity and content where necessary to ensure compliance with these Terms. We may suspend or permanently terminate your access to the platform if you are found to be in violation of any prohibited use, and we reserve the right to report such activity to relevant authorities where applicable.
09. Underage Users
Adperformo’s services are intended solely for individuals who are 18 years of age or older. By registering an account or accessing any part of the platform, you confirm that you meet this minimum age requirement and have the legal capacity to enter into a binding agreement.
If it is discovered that an individual under the age of 18 has registered or used the platform in any capacity, Adperformo reserves the right to immediately suspend or terminate the account without prior notice. In such cases, any payments made or received in connection with the account may be withheld or forfeited, at our discretion.
This policy is in place to ensure compliance with applicable legal regulations and to protect both users and the integrity of the Adperformo platform from the risks associated with underage usage.
10. User Responsibilities
Users of the Adperformo platform are solely responsible for understanding and complying with the tax laws and financial regulations of their country or jurisdiction in connection with any payments made to or received from Adperformo. This includes, but is not limited to, the declaration and payment of any applicable income taxes, VAT, or other levies related to the use of the platform’s services.
Users are also responsible for ensuring that any content or deliverables obtained through Adperformo are used in accordance with all applicable laws, regulations, and ethical standards. Adperformo shall not be held liable for any misuse of the delivered materials or for any legal consequences arising from the user’s failure to comply with local or international legal requirements.
11. Risks of the Service
Adperformo connects clients with freelance creative professionals and facilitates the delivery of digital services, but does not execute the creative work directly. As with any creative collaboration, there may be variations in individual style, interpretation, or execution depending on the freelancer assigned to the project.
While Adperformo applies a quality control process and strives to match each project with a qualified professional, we cannot guarantee that all deliverables will meet subjective stylistic preferences or personal expectations. By using the platform, you acknowledge and accept the inherent creative variability in services such as design, illustration, branding, and content production.
Adperformo facilitates the process but shall not be held liable for stylistic differences, creative interpretation, or minor inaccuracies in the final deliverables, provided the work aligns with the general scope and requirements of the original brief.
12. General Conditions
Adperformo, operated by LINGO VENTURES LTD, reserves the right to refuse access to the platform or the provision of services to any individual or entity, at any time, and for any reason, without the obligation to disclose the grounds for such refusal.
You acknowledge that any content you submit or transmit through the platform (excluding payment information) may be transferred over unencrypted networks and may be modified to meet technical requirements of various systems or devices. However, payment information such as credit card data is always encrypted and protected during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, any use of the Service, or access to the Service or any contact available through the website, without prior express written permission from Adperformo.
The headings in this agreement are included for convenience only and shall not affect the interpretation or scope of any provision within these Terms of Use.
13. Accuracy, Completeness and Timeliness of Information
Adperformo makes reasonable efforts to ensure that the information presented on the website is accurate and up to date. However, we do not warrant that all information available on the platform is complete, current, or free from errors. All materials are provided for general informational purposes only and should not be relied upon as the sole basis for making decisions without consulting independent, primary, or more accurate sources.

While we reserve the right to modify or update any content on the website at any time, we are under no obligation to do so. Adperformo reserves the right to modify, adjust, or discontinue any aspect of the platform or the services offered through it, including pricing, scope of services, or availability, at any time and without prior notice. This may include the addition or removal of specific service categories, changes to project workflows, or updates to platform features.
We may also revise our pricing structure without obligation to provide prior notice. Such changes may apply to future projects and service engagements and will not affect transactions that have already been confirmed.
Adperformo shall not be held liable to you or to any third party for any modifications, price changes, suspension, or discontinuation of the Service or any part thereof.
15. Services
All services offered by Adperformo are available exclusively through the online platform. Access to these services is subject to the terms outlined in our Refund Policy, which governs eligibility for refunds and dispute resolution.
We reserve the right, without obligation, to limit the provision of services to any individual, business, geographic location, or jurisdiction, and may enforce such limitations on a case-by-case basis. Descriptions of services, as well as service availability and pricing, are subject to change at any time and without prior notice, at our sole discretion. We further reserve the right to modify, suspend, or discontinue any service offering at any time. Any service offering made on this platform shall be considered void where prohibited by applicable law.
While Adperformo takes reasonable measures to ensure service quality and accuracy, we do not guarantee that the outcome of any service, or the materials provided through it, will fully meet your personal expectations. We do not warrant that any defects or issues in the service will be corrected unless expressly agreed.
16. Accuracy of Billing and Account Information
Adperformo reserves the right to refuse, limit, or cancel any order or project request placed through the platform, at our sole discretion. These limitations may apply to orders associated with the same user account, payment method, billing address, or any other identifying information. If we make a change to or cancel an order, we may attempt to notify you using the email address, billing address, or phone number provided at the time of the transaction.
By using the platform, you agree to provide accurate, complete, and up-to-date billing, payment, and account information for all transactions. You are responsible for keeping your information current, including your email address and payment details, so that we can process your orders and communicate with you when necessary. Failure to do so may result in delays, failed transactions, or suspension of access to services.
17. Optional Tools
From time to time, Adperformo may provide access to third-party tools or integrations that are made available through the platform but are not operated, controlled, or actively monitored by us. You acknowledge and agree that such tools are provided on an “as is” and “as available” basis, without any warranties, guarantees, or representations of any kind, and without any endorsement by Adperformo.
We shall not be held liable for any issues, losses, or damages arising out of or related to your use of any optional third-party tools or services. Your use of these tools is entirely at your own risk and discretion, and it is your responsibility to review and accept any applicable terms and conditions provided by the respective third-party providers.
Adperformo may also, in the future, introduce new features, tools, or services through the website. Such additions will be subject to these Terms of Use unless otherwise specified.
18. Personal Information
The submission and handling of your personal information through the Adperformo platform is governed by our Privacy Policy. By using the website and our services, you acknowledge and agree to the collection, use, and disclosure of your personal data in accordance with that policy.
19. Prohibited Uses
Adperformo does not guarantee, represent, or warrant that your use of the platform or any of its services will be uninterrupted, timely, secure, or error-free. We do not make any guarantees regarding the accuracy, reliability, or expected outcomes of services obtained through the platform. You acknowledge that the availability and functionality of the service may be suspended or discontinued at any time, without prior notice, and that such interruptions may occur without liability on our part.
You expressly agree that your use of the platform and its services, or your inability to use them, is at your sole risk. Unless expressly stated otherwise, all services and content delivered through the platform are provided on an "as is" and "as available" basis, without warranties or conditions of any kind, either express or implied. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, durability, non-infringement, or title.
Under no circumstances shall Adperformo, or its directors, officers, employees, affiliates, agents, contractors, partners, suppliers, or licensors be liable for any injury, loss, or claim, or for any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages—whether arising in contract, tort (including negligence), strict liability, or otherwise—related to your use of the service or any content obtained through it.
This limitation applies even if Adperformo has been advised of the possibility of such damages. Some jurisdictions do not allow limitations on implied warranties or exclusions of liability for certain types of damages. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.
20. Severability
If any provision of these Terms of Use is found to be unlawful, invalid, or unenforceable under applicable law, such provision shall nonetheless be enforceable to the maximum extent permitted. The unenforceable portion shall be deemed severed from these Terms, and such a determination shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
21. Termination
These Terms of Use shall remain in effect unless and until terminated either by you or by Adperformo. You may terminate these Terms at any time by providing written notice that you no longer wish to use our services or by ceasing to access the platform.
Adperformo reserves the right, at its sole discretion, to suspend or terminate your access to the platform and services at any time without prior notice if we determine, or reasonably suspect, that you have violated any provision of these Terms, applicable laws, or engaged in any fraudulent, abusive, or unlawful activity. Upon termination, you remain liable for any outstanding amounts due up to and including the date of termination.
We specifically reserve the right to terminate accounts for reasons including, but not limited to, non-payment, use of unauthorized or fraudulent payment methods, violation of these Terms of Use, or breach of any applicable legal or regulatory requirements. In cases involving unauthorized payment activity, we may permanently suspend your account and withhold any related payments or refunds.
22. Delivery Terms
Completed projects will be delivered electronically either to your registered email address or directly through your account on the Adperformo platform within the agreed timeframe. Delivery schedules are determined based on the scope, complexity, and volume of the specific project as outlined at the time of confirmation.
Adperformo is committed to timely delivery and will make reasonable efforts to meet the stated deadlines. In the event of any anticipated delays, we will communicate promptly and transparently with the client. Final deliverables will remain accessible through your account unless otherwise specified in the service agreement.
23. Complaints
Adperformo values all client feedback and is committed to addressing complaints related to the quality of delivered services in a prompt and professional manner. This section outlines the procedure for submitting complaints, the scope of issues that may be reviewed, and how such matters are handled.
To submit a complaint, you must contact us in writing via email at [email protected]. The complaint must be sent from the email address verified during your account registration. Your message must include your full name and account details, the order number and date of delivery, a detailed description of the issue encountered, and specific examples supporting your concern. Complaints must be submitted within seven calendar days from the date the final deliverable was provided. Submissions received after this period may not be accepted unless exceptional circumstances apply. Upon receipt of your complaint, we will acknowledge it within seven business days and inform you of the estimated timeframe for review and resolution.
Complaints may be submitted in cases involving objective errors, including grammatical mistakes, formatting issues, layout discrepancies, omissions, or significant deviations from the original brief. Unjustified delays in delivery without prior notice may also be subject to review. If, after internal evaluation, the complaint is deemed valid, Adperformo may offer free revisions to address the identified issues.
Complaints based solely on subjective stylistic preferences or creative direction—if such preferences were not clearly communicated prior to project commencement—may not qualify for correction. Additionally, complaints that seek to expand the scope of the original project may be declined.
24. Payment Policy
All services provided through the Adperformo platform are subject to a 100% prepayment requirement. Work on any project will commence only after full payment has been successfully received and confirmed. No exceptions will be made unless explicitly agreed upon in writing by Adperformo prior to the start of the project. 25. Refund Policy
Due to the customized and digital nature of creative services provided through Adperformo, refunds will only be considered in cases of confirmed non-delivery or in instances where the delivered work deviates substantially from the agreed project requirements. Each case will be assessed individually, and Adperformo reserves the right to offer revisions or alternative solutions before processing any refund requests.
Since creative digital deliverables cannot be returned once delivered, we offer up to two rounds of revisions free of charge, provided that the request is submitted within seven calendar days of delivery. All revision requests must remain within the original scope and specifications of the project as defined at the time of order confirmation. If the requested changes go beyond the original project scope, additional charges may apply.
Our goal is to ensure client satisfaction, and we are committed to working collaboratively with you to resolve any quality concerns or misunderstandings within the specified revision period.
26. Confidentiality
Adperformo is committed to maintaining the confidentiality of all client materials and information submitted in connection with the services provided. All documents and data shared by the client are handled securely and are accessible only to authorized personnel and freelancers who are contractually bound by confidentiality obligations.
Client files are stored in a secure environment for a period of one year following the completion of the project, after which they are permanently deleted unless the client requests otherwise in writing. Adperformo undertakes to treat all transferred materials and any information disclosed during the delivery of services as strictly confidential.
We also ensure that all freelancers, including designers, writers, voice artists, and other contributors engaged by Adperformo, are contractually obligated to respect the confidentiality of the materials and information to which they have access in the course of their work.
27.Dispute Resolution
In the event of any dispute arising from or relating to the use of the Adperformo platform or the services provided through it, the parties agree to make every reasonable effort to resolve the issue through direct communication, negotiation, and mutual consultation. To initiate the dispute resolution process, you must first contact our customer support team using the official communication channels provided on the platform.
Adperformo is committed to working collaboratively and in good faith to resolve any disputes efficiently and fairly, without the need for formal legal proceedings wherever possible.
This website is governed under laws of England and Wales.
28. Arbitration
If a dispute cannot be resolved through direct negotiation and consultation, both parties agree that any dispute, controversy, or claim arising out of or relating to these Terms of Use, the use of the Adperformo platform, or the services provided, shall be finally resolved through arbitration.
The arbitration shall be conducted in accordance with the rules and procedures of the London Court of International Arbitration (LCIA). The decision of the arbitral tribunal shall be final and binding on both parties. Each party agrees to abide by the outcome of the arbitration and acknowledges that it constitutes the exclusive method for resolving such disputes, except where otherwise required by applicable law.
29. Intellectual Property Rights
Unless explicitly stated otherwise in a written agreement, all creative works and deliverables produced through the Adperformo platform remain the property of Adperformo until full payment has been received and intellectual property rights have been formally transferred to the client. Upon confirmation of full payment, the client may receive usage rights as specified in the service agreement or project brief.
No content delivered through the platform may be reproduced, published, distributed, or used for any legal, commercial, or public purpose by Adperformo, its freelancers, or any third party without the client’s prior written consent. Similarly, clients may not use, modify, or redistribute any work unless the rights have been granted in accordance with these Terms.
30. Force Majeure
Adperformo shall not be held liable for any delay or failure to perform its obligations under these Terms of Use due to events beyond its reasonable control. This includes, but is not limited to, natural disasters, acts of government, war, civil unrest, labor disruptions, epidemics, pandemics, internet or telecommunication failures, or other unforeseen events that render performance impracticable or impossible. In such cases, affected obligations shall be suspended for the duration of the force majeure event.
31. Changes to Terms of Use
The most current version of these Terms of Use is always available on this page. Adperformo reserves the right, at its sole discretion, to update, modify, or replace any part of these Terms at any time by posting changes to the website. It is your responsibility to periodically review the Terms of Use for updates. Continued use of the platform or its services after any such changes have been posted constitutes your acceptance of the updated Terms.
